Terms of Service.

1. Acceptance of Terms

By accessing the BB Fleet Tracker web portal, installing the mobile application, or deploying FMC920 hardware nodes, you agree to be bound by these Terms of Service. These terms govern the relationship between Binary Budds ("we", "us", "our") and the contracting Educational Institution or Transport Provider ("you", "your", "Client").

2. Eligibility & Permitted Users

BB Fleet Tracker is a professional fleet management platform intended exclusively for:

  • School administrators managing student transport operations
  • Authorised bus drivers employed by or contracted to the Client
  • Parents or guardians of students enrolled at the Client institution

The platform is not intended for direct use by minors under the age of 13. The Client is responsible for ensuring that all accounts created within their organisation comply with applicable child protection and data privacy laws. Students are represented within the system as records managed by school administrators — students themselves do not hold direct accounts.

"System access is strictly limited to authorised personnel. Sharing portal credentials with unauthorised third parties is a material breach of this agreement."

3. Hardware Usage & Warranty

All telemetry hardware (FMC920) must be installed by certified technicians to ensure data integrity. Binary Budds is not liable for data gaps caused by improper installation, shielding of GPS antennas, or unauthorised tampering with hardware nodes. The Client is responsible for maintaining hardware in the condition supplied and for reporting faults promptly.

4. Acceptable Use Policy

The platform must be used solely for the safety and optimisation of student logistics. The following uses are strictly prohibited:

  • Using telemetry or location data for unauthorised surveillance of individuals
  • Discriminatory routing practices based on student demographics
  • Sharing access credentials with unauthorised third parties
  • Attempting to access data belonging to other school organisations
  • Reverse engineering, decompiling, or extracting source code from the platform
  • Using the platform for any unlawful purpose

Violation of this policy will result in immediate suspension and potential termination of service without refund.

5. Service Level Agreement (SLA)

We strive for 99.9% uptime for our cloud-based tracking portal. Scheduled maintenance is typically performed during non-operational hours (weekends and late-night windows) to minimise disruption to school transport schedules. Downtime caused by third-party infrastructure providers (Supabase, Firebase, InfluxDB) or force majeure events does not count against our SLA obligations.

6. Account Termination

Either party may terminate the service agreement with 30 days written notice. Binary Budds reserves the right to terminate or suspend access immediately and without notice in cases of:

  • Material breach of these Terms of Service
  • Non-payment of fees
  • Conduct that poses a security risk to other users or the platform
  • Legal or regulatory requirement

Upon termination, the Client's data will be retained for 30 days to allow export, after which it will be permanently deleted. Individual users may request account deletion at any time via fleet.binarybudds.com/delete-account.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Binary Budds shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. This includes, without limitation, loss of data, loss of revenue, or harm arising from reliance on GPS tracking information. The total liability of Binary Budds for any claim arising under these terms shall not exceed the fees paid by the Client in the three months preceding the claim.

8. Intellectual Property

All software, interfaces, algorithms, and branding associated with BB Fleet Tracker are the exclusive intellectual property of Binary Budds. The Client is granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during the subscription term. No ownership rights are transferred.

9. Governing Law

These Terms of Service are governed by the laws of India. Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in India. For clients in the European Union, applicable GDPR obligations take precedence over conflicting provisions.

10. Changes to These Terms

We may revise these Terms of Service from time to time. When material changes are made, we will update the "Last Revised" date above and notify active clients via email. Continued use of the Service after the effective date of changes constitutes acceptance of the revised terms.
